📋Agreement to Terms

By downloading, installing, or using the KineLab iOS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you ("User") and KineLab regarding your use of the App.

⚖️License Grant

Limited License

Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on iOS devices you own or control
• Use the App for personal or professional biomechanical analysis
• Process videos and generate analysis reports

License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter copyright, trademark, or proprietary notices
• Use the App for unlawful or unauthorized purposes
• Rent, lease, lend, sell, or redistribute the App
• Extract or attempt to extract AI models or algorithms

👤User Responsibilities

Research Ethics

If using KineLab for research involving human subjects, you are responsible for:

• Obtaining proper informed consent from all participants
• Complying with institutional review board (IRB) requirements
• Following research ethics regulations (GDPR, HIPAA, etc.)
• Ensuring participant privacy and data security

Video Content

You must:

• Have permission to record and analyze all individuals in videos
• Comply with privacy laws when recording videos
• Not process videos containing illegal content
• Respect the privacy and dignity of all individuals

⚠️Disclaimer of Warranties

No Warranties

To the maximum extent permitted by law, we disclaim all warranties, including:

• Accuracy: Results may not be accurate, complete, or error-free
• Reliability: App may not function without interruption
• Medical Use: NOT a medical device, not for clinical diagnosis
• Performance: Results vary based on video quality and conditions

Not a Medical Device: KineLab is for research and coaching only. It is NOT intended to diagnose, treat, cure, or prevent any disease. Always consult healthcare professionals for medical advice.

🛡️Limitation of Liability

We are not liable for:

• Injuries from training/testing based on App results
• Inaccurate measurements or analysis errors
• Data loss, even if advised of possibility
• Decisions made based on App-generated data

Our Rights

KineLab retains all rights, title, and interest in:

• The KineLab application and all components
• All AI models, algorithms, and software code
• The KineLab name, logo, and branding

Your Data Rights

You retain all rights to:

• Videos you import into the App
• Exported data (CSV files, reports)
• Research findings based on App-generated data

We do not claim ownership of your videos or exported data. All processing happens locally on your device.

🧪Beta Program Terms

By participating in the beta program, you acknowledge:

• The App is pre-release and may contain bugs
• Features may change or be removed without notice
• The App may crash, freeze, or behave unexpectedly
• You use the beta version at your own risk

We may terminate the beta program or your participation at any time without notice.

🔒Privacy and Data Processing

KineLab processes all videos locally on your device. We do NOT:

• Upload your videos to servers
• Collect or store your pose data
• Access your athlete profiles
• Share your data with third parties

🚪Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access if you violate these Terms.

Upon termination, your license ends immediately. Data on your device is not automatically deleted.

🔄Updates and Changes

We may release updates to improve functionality or fix bugs. Updates may be required to continue using the App.

We may modify these Terms at any time. Material changes become effective 30 days after notification. Continued use constitutes acceptance.

⚖️Governing Law

These Terms are governed by the laws of Poland. Disputes will be resolved according to Polish jurisdiction.
